Medical Rights of Inmates with Schizophrenia
In July of this year, Control Yuan Investigation Report 109-SZ-Diao-0051 was released, issuing corrective measures proposed against the Ministry of Justice, Taipei Prison, and Taichung Prison. The investigation report pointed out that the procedures for initiating and reviewing current applications for medical parole remain unclear; there is a lack of integration and coordination mechanisms between prisons and Peite Hospital regarding inmates' conditions and medical treatments, causing severely ill inmates to be bounced around like medical pinballs; furthermore, the review mechanism for whether to admit inmates suffering from multiple illnesses lacks cross-departmental integrated assessments. Overall, these issues have led to severe violations of medical human rights within correctional institutions.
Regarding this case, the JRF is currently deliberating whether to assist the family in filing a state compensation lawsuit. The JRF will also continue to monitor whether the promotion of overall medical human rights in correctional institutions—whether under the external inspection teams of the newly enacted Enforcement of Punishments Act or through the operations of the National Human Rights Commission under the Control Yuan—can play a positive role in uncovering systemic problems and guiding improvements.
